1. Acceptance of Terms
By accessing our websites, communities, or purchasing any product or membership, you agree to these Terms of Service. "Gym Mentor", "we", or "us" means Gym Mentor Pty Ltd. "You" means the customer, member, or user.
These terms cover our services, including: AI automation and integrations, CRM setup, chatbots and voice AI agents via MentorAI, marketing strategy and copywriting, online courses and challenge programs, the Gym Mentor Member (free) and Premium Membership/VIP (paid) tiers, and access to our communities and resources.
2. Memberships and Benefits
- Gym Mentor Member (free): access to the community space, standard templates, selected trainings, live session invites when applicable.
- Premium Membership/VIP (paid): access to premium trainings, funnels and templates, live coaching calls, support, ticketing, resource library, and other benefits described at checkout. Inclusions may change over time. Where we materially reduce inclusions during a current billing cycle, we will notify you in advance and you may cancel before the next renewal.
3. MentorAI Subscription Terms (if purchased)
- 7 day free trial with full access
- After the trial, a 1 month minimum term applies
- Pricing: USD $150 per month plus usage charges (currently $0.27 per calling minute and $0.02 per workflow execution, or as shown at checkout)
- Early termination requires payment of remaining 1 months in the term
- You authorise recurring billing to your nominated payment method
4. Payments, Billing, and Refunds
- Prices are shown in USD unless stated otherwise
- Memberships are billed monthly or annually as selected and renew until cancelled
- Setup fees and one-time payments are non-refundable unless we state otherwise in writing
- For memberships: cancel anytime with 30 days written notice before your next billing date. Cancellation takes effect at the end of the current paid period. No pro-rata refunds for partial periods.
- For MentorAI: the 1 month term and early termination rule in Section 3 applies
5. Client Responsibilities
You will provide timely access to information, accounts, and assets we need to deliver services, and promptly review and approve deliverables. You will not misuse or resell our proprietary materials without written permission.
6. Community Guidelines
Be respectful, constructive, and lawful. No harassment, hate speech, illegal or infringing content, or unsolicited promotion. We may moderate content and suspend or remove members for breaches without refund where serious misconduct occurs.
7. Intellectual Property
All materials we create, including training, templates, automations, scripts, and strategy, remain our intellectual property. We grant you a non-exclusive, non-transferable licence to use those materials within your business while your membership is current or under a separate licence stated in an order form.
8. Results Disclaimer
We do not guarantee specific outcomes including revenue, lead volume, cost per lead, or fitness results. Results depend on your offers, market, execution, compliance with platform rules, and third-party systems.
9. Platform and Third Party Services
We use third-party providers such as GoHighLevel, Twilio, Zapier, Circle, Meta, Google, and others. Their terms and acceptable use policies apply. We are not liable for outages, changes, or limits imposed by third parties.
10. Communications and Consents
You authorise us to send you transactional and service messages related to your account, orders, or support. Marketing messages by email or SMS require your consent as set out in the Privacy Policy and Opt-in Terms.
We will only send SMS where you have separately agreed by ticking a consent checkbox. Consent is not a condition of purchase and message frequency may vary.
11. Termination and Suspension
We may suspend or terminate services or membership for non-payment, breach of these terms, unlawful conduct, or platform abuse. Cancellation follows Section 4 for memberships, Section 3 for MentorAI.
12. Governing Law and Disputes
These terms are governed by the laws of Queensland, Australia. Parties submit to the non-exclusive jurisdiction of the courts of Queensland. For US customers, claims must first go through good faith negotiation for 30 days before either party commences proceedings.

By opting in to the Gym Mentor SMS program, you agree to receive recurring marketing and transactional text messages at the mobile number provided. Consent is not a condition of purchase.

This Privacy Policy applies to our websites, communities, products, memberships, events, and services, including MentorAI. It explains how we collect, use, disclose, and store personal information, and how you can access, correct, or delete your information.

- Payment and billing information (processed by providers)
- Communications and support interactions, including call or chat recordings where disclosed
- Usage data (device, IP, pages visited, actions in platforms)
- Community content you choose to post
- Consents and preferences for marketing and communications
3. How We Use Information
We use information to deliver and improve services, provide customer support, personalise content, operate communities, process payments, send transactional notices, and, where permitted, send marketing.
We do not sell personal information.
4. Legal Bases and Direct Marketing
We follow:
- Australia: Spam Act 2003, Privacy Principles
- US: CAN-SPAM (email), TCPA + wireless industry guidelines (SMS)
Direct marketing is sent only with appropriate consent. You can opt out anytime.
5. SMS Marketing & Communications
When you provide your mobile number and consent to receive SMS from Gym Mentor, we will send you marketing and transactional text messages.
- Message frequency varies, up to 5 per week for marketing, plus transactional reminders.
- Message and data rates may apply.
- You may opt out at any time by replying STOP to any message. You will then receive one final confirmation message.
- To rejoin, text START or UNSTOP, or re-submit your details via our website.

We record your consent with the exact wording you saw at sign-up, including timestamp, IP address, mobile number, and opt-in method, to comply with US TCPA and CTIA guidelines, as well as Australian Spam Act 2003 and Privacy Act 1988.

6. Sharing and Disclosure
We share data with contracted service providers (hosting, analytics, payment, communications, customer support).
We may disclose information if required by law or to protect rights/safety.
We do not sell, share, or rent personal data, including mobile information, to unaffiliated or affiliated third parties for their own marketing purposes. SMS opt-in data and consent will not be shared with any third parties. Sharing with subcontractors for customer service delivery is permitted, provided they do not use data for their own marketing.

Data may be stored or processed in Australia, the US, or other provider locations, with safeguards in place.
8. Security
We apply technical and organisational measures to protect information. If a data incident creates risk of harm, we will notify as required by law.
